VENDOR AGREEMENT

I agree to and understand the following:

  • All vendors must be approved by the Vendor Coordinator, preference is given to vendors who demonstrate crowd interaction through activations, activities, or other unique displays. SSOM reserves the right to refuse or rescind my application.

  • This event will occur rain or shine. In the event that severe weather should occur (lightning, hail, tornadoes, or other weather deemed dangerous), the SSOM team will cancel 24hrs in advance when possible. 

  • Vendor fees are non-refundable.

  • Due to the diverse attendance at each event, we ask that no political or religious organizations apply for vendor space. If you apply and are in fact affiliated with a political or religious organization - we will cancel your application and refund your fee.

  • I have researched and attained any vendor licensing needed for me to sell my wares. For information about City of Cincinnati vending at events click here. Food licensing click here.

  • By submitting payment I agree to attend all the dates I have registered for. I acknowledge the event hours and agree to participate for the full event time. No early set-up or departure is permitted. If I cannot make it to an event, I will notify SSOM via email at SSOMVendors@gmail.com within 72hrs of the event.

  • I have read and agree to follow the SSOM load-in and load-out instructions.

  • I have read and agreed to the SSOM Vendor Code of Conduct and Hold Harmless Waiver

As a vendor I am responsible for and will bring my own:

  1. Table and chairs

  2. Canopy / tent and weights for each leg (weights are REQUIRED for set-up, no exceptions)

  3. Products and materials

  4. Payment processors or cash to make change for sales, wifi is not provided

  5. Any required permits, licenses, and/or insurance

  6. Portable electricity/ silent generators, or power cords. Gasoline generators are not permitted unless given written approval by Vendor Coordinator.

  7. Water or other sanitary items (ie. food vendors)

SSOM reserves the right to refuse an application at its discretion (ie. to avoid duplication, non-family content, or religious affiliation), and also reserves the right to remove a vendor for just cause without incurring liability by that vendor for removal. No refunds will be given for any reason.

Hold Harmless and Waiver Agreement

By applying for a booth at SSOM, I, the Vendor, hereby undertake to protect, defend, hold harmless, and fully indemnify Second Sunday on Main and Over-the-Rhine Chamber of Commerce and any subsidiaries or successors for any and all liability, claim, demands, or cause of action of whatsoever kind of nature, either in law or equity, which may hereafter arise from my participation with Second Sunday on Main.

I, the Vendor,  agree to participate in the OTR Chamber's Second Sunday on Main using recommended and mandated safe-practices, including Covid-19 guidelines per Ohio State Law.  I acknowledge and agree that the State of Ohio has issued regulations and best and agree to comply with all state, local, or federal rules that are in place at the time of this activation. If I come into any contact with someone who tests positive or becomes symptomatic at any point before the activation I will not attend, vendor fee refunds will be made if this should occur. I release and forever discharge SSOM/OTRCC from any claims or damages associated with the novel coronavirus under this Agreement.

I, the Vendor, understand and acknowledge that this Release discharges Second Sunday on Main and Over-the-Rhine Chamber of Commerce from any liability or claim that I may have against Second Sunday on Main or any affiliates with respect to any bodily or other injury, illness, death, or property damage that may result from my participation.  I also understand that Second Sunday on Main and Over-the-Rhine Chamber of Commerce does not assume any responsibility or obligation to provide financial assistance or other assistance including, but not limited to, medical, health, or disability insurance, in the event of injury, illness, death, or property damage.

I, the Vendor, understand that I will be responsible for my own liability/personal insurance and fire protection (if necessary), and agree that neither SSOM nor the OTRCC is liable for any damage or other losses , including: property damage or personal injury that may occur during this event.  I assume all risk of injury or harm in the activities associated with Second Sunday on Main.   I, the Vendor, shall take all reasonable and prudent steps to protect the safety of the public, customers, staff, and participants. 

I, the Vendor, herby grant and convey unto Second Sunday on Main and the Over-the-Rhine Chamber of Commerce rights, titles, and interest in and to any and all photographic images and video or audio recordings made by or on behalf of Second Sunday on Main and the Over-the-Rhine Chamber of Commerce, or made with its consent, during my participation in SSOM, including but not limited to any royalties, proceeds, or benefits derived from such photographs or recordings.

I, the Vendor, expressly understand and agree that this Release is intended to be as broad and inclusive as permitted by law, and that this Release shall be governed by and interpreted in accordance with the laws of this state, county, city and/or township. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release.
